Plea versus Trial – Odds May Be Against the Truly Innocent (Attorney)

A recent study of those charged with felony crimes as reported data from State Court statistics examined differences in the outcomes achieved by the public defender, assigned counsel, and private attorneys.  One of the most shocking statistics in the study is the percentage of defendants that end up pleading guilty to felony charges.  Regardless of the type of attorney they had, some 96 to 97% of those charged ended up pleading guilty.

Business Planning & Legal Housekeeping (LLC & Corporation's Attorney)

As a business owner starts out, it is a good idea to establish a business plan.

It's equally important to include legal planning in your planning.

Plan on meeting with an attorney to decide whether you should set up the business as a 1) sole proprietorship with an assumed name (aka D/B/A), 2) partnership, 3) limited liability company (LLC), or 4) Corporation (Inc.).

Collection Matters-- start the collection process as soon as you can

In this day and age, businesses and customers are more likely to fail to pay you for money owed.

Clients need to have internal policies to monitor their accounts receivables regularly. When accounts are late, special letters need to go out after 45 days. More pressing letters need to go out at 60 days and 90 days.

You need to have trigger points to call an attorney and start a collection lawsuit. Do not sit on old accounts. As a general rule, the older the case, the harder to collect.
