High Rock Lake Boating Death:2 boats collided on High Rock Lake in Davidson County, North Carolina about 12:30 p.m. this summer. The accident threw Melissa Chambers Britt, 32, into the water. Searchers found her body a few hours later. Authorities said Melissa Britt was pregnant. Mrs. Britt’s son, William Jaiden Britt, died at a hospital shortly after the crash. Mrs. Britt’s brother, Michael Chambers, was transported to Wake Forest Baptist Medical Center with critical head injuries after the collision. Clay Britt, Mrs. Britt’s husband, was driving the pontoon boat but was uninjured.
Investigators said the Britt’s pontoon boat collided with a speedboat. None of the people in the speedboat were injured, per investigators. Michael Greene, 53, of McLeansville, NC was operating the speedboat, investigators said. It was travelling between 35 - 45 mph when the crash occurred.
While there are no speed limits on the lake, inattention may have been a factor.
N.C. Wildlife Resources Commission Sgt. Anthony Sharum said the speedboat driver looked down at his instrument panel just before the crash.
The Davidson County District Attorney’s Office filed charges for involuntary manslaughter.
From a civil action perspective, a claim for wrongful death could be pursued by the injured pontoon boat riders against the speed boat driver. If the speed boat driver was inattentive, then a court could determine he breached his duty to drive the boat, thus proximately causing the death and injuries of the pontoon boat driver.
Wrongful death cases include damages for pain and suffering of the decedents, loss of consortium of the decedent, lost earning capacity, and funeral and medical expenses.
