When a person drives and talks on a cell phone (mobile phone) they are distracted. There's no question about it.
In a study by the National Safety Council, drivers talking on mobile phones and driving are driving as unaware as if they were legally intoxicated. See excerpt from http://www.cellphonesafety.org/vehicular/era.htm
Cell phone usage, whether hands free or held, is the equivalent of driving drunk.

Over the weekend, Babe Thompson was hit by a driver and killed. The driver committed 'hit and run', but later turned himself in. Charges are being pressed.
In this situation, it appears that Mr. Thompson's estate has a wrongful death claim against the driver and his vehicle insurance policy.
When there is a wrongful death claim in North Carolina, there is a 2 year statute of limitations in which the claim can be brought in the courts.

Two North Carolina residents were killed in a boating accident in Nebraska. The driver of the pontoon boat was arrested for boating while intoxicated.
There appears to be a tendency of boat drivers to think its alright to operate a boat drunk when they would be legally intoxicated driving a vehicle. This isn't so.
One small mistake operating a boat can cause serious bodily injury to people in the boat one drives and other boaters.
Be cautious and boat defensively on the lakes.

Rarely a week goes by that I don’t hear from someone who used to live in this part of North Carolina. The Triad is a great place to live, work, and go to school. Most of those that call me would agree. In addition to the memories of good experiences had here, however, they carry with them the baggage of at least one bad experience – a criminal charge or conviction.
